 1. Personal data

Dbanyan processes your personal data because you use our services and/or because you provide them to us yourself.

Below you will find an overview of the personal data that we process:

  • First and last name
  • Address data
  • Phone number
  • E-mail address
  • Other personal data that you actively provide, for example by creating a profile on this website, in correspondence and by telephone
  • Information about your activities on our websit

2. Special and/or sensitive personal data

    Our website and/or service does not intend to collect data about website visitors who are younger than 16 years of age. Unless they have parental or guardian permission. However, we cannot check whether a visitor is older than 16. We therefore advise parents to be involved in the online activities of their children, in order to prevent data about children being collected without parental consent. If you are convinced that we have collected personal information about a minor without this permission, please contact us at contact@dbanyan.com and we will delete this information. 

    3. Dbanyan processes your personal data for the      following purposes:

      • Sending our newsletter and/or advertising brochure
      • To be able to call or e-mail you if this is necessary to be able to carry out our services
      • To inform you about changes to our services and products
      • Offer you the option to create an account
      • To deliver goods and services to you
      • Dbanyan analyses your behaviour on the website in order to improve the website and to tailor the range of products and services to your preferences.

      4.  Automated decision making

        Dbanyan does not use automated decision-making programs that can have significant impact on the people.

        5. How long we keep personal data

          Dbanyan does not store your personal data for longer than is strictly necessary to realize the purposes for which your data is collected. We use the following retention periods for the following (categories) of personal data:

          5.1 We will continue to process the personal data for a period of two (2) years after your last order, or for as long as legally required or necessary and permitted for the purpose or purposes for which the data was obtained. Immediately after these periods we will destroy and/or anonymize the personal data.

          5.2 The following (non-exhaustive) list of criteria is used to determine our retention periods (i) the duration of our ongoing relationship with you and the services that we offer; (ii) our subjection, if any, to any legal obligation(s); and (iii) other legal requirements (such as applicable statute of limitations, lawsuits, or internal or external investigations).

          5.3 Notwithstanding Article 5.1 of this Privacy Policy, we may process the personal data for a longer period (i) if you ask us to keep the personal data for an additional two (2) years; or (ii) to comply with legal retention periods (as required by tax law, for example); or (iii) to demonstrate compliance with applicable legal obligations (resulting from, for example, the GDPR or marketing legislation).

          5.4 If you request deletion of your personal data by contacting us through the process described in Article 8 of this Privacy Policy, all your personal data processed through our Website will be deleted, as also required by applicable law. This does not apply if we are required by law, for the completion of the transaction for which the data was processed, or for internal use, to keep such data. 

          6. Sharing personal data with third parties

            Dbanyan does not sell your data to third parties and only provides it if this is necessary for the execution of our agreement with you or to comply with a legal obligation. We conclude a processor agreement with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data. Dbanyan remains responsible for these processing operations.

            7. Cookies, or similar techniques, we use

              Dbanyan uses functional, analytical and tracking cookies. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you first visit this website. Dbanyan uses cookies with a purely technical functionality. These ensure that the website works properly and that, for example, your preferred settings are remembered. These cookies are also used to make the website work properly and to be able to optimize it.               8. View, modify or delete data

                You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your consent to the data processing or to object to the processing of your personal data by Dbanyan and you have the right to data portability. This means that you can submit a request to us to send the personal data we have about you in a computer file to you or another organization mentioned by you.

                You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to contact@dbanyan.com.

                To ensure that the request for access has been made by you, we ask you to send a copy of your proof of identity with the request. Make your passport photo with MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN) black in this copy. This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.

                9. How we protect personal data

                  Dbanyan takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. If you have the impression that your data is not properly secured or there are indications of abuse, please contact our customer service or via contact@dbanyan.com. Dbanyan has taken the following measures to protect your personal data:

                  10. Revisions to this Privacy Policy

                    Please note that this Privacy Policy may be revised from time to time. Any revision of the Privacy Policy will be posted on our Website, where the most current version will be available at all times. We recommend that you regularly check our Website and Privacy Policy. If we make a change to this Privacy Policy that would affect your privacy rights, we will either seek your consent to the change or continue to comply with our previous Privacy Policy if it concerns information that we processed when this previous Privacy Policy was in effect. The last revision took place in October 2021.
